Customs Procedures for Temporarily Imported Goods in China
1. Declarations
Consignee of the temporarily imported goods should finish three copies of the Import Goods Declaration Form, indicating temporarily imported goods. The form, together with the list of imported goods and papers of approval from the department in charge of the state council and the department, bureau in charge of the listed cities, autonomous regions and provinces, should be submitted to the customs in the importing place. Two copies of the list of temporarily imported exhibits including the shipping marks, number, weight, name, dimensions and price should be translated into Chinese and presented to the customs where the exhibition is to be held by the exhibition company or its agent before the importation. When the exhibits have arrived, the exhibitor should present before the customs in the import place a PRC Customs Importation Transfer Goods Declaration Form signed and stamped by the customs in the exhibiting place, as well as other documents, to declare to the customs in the import place.
As for the following goods, a certificate from the related department should be submitted when imported.
1) Wireless instruments: A seal on the declaration form or a certificate, both by China Commodity Inspection Organs.
2) Animals and Plants: Quarantine Clearance Notice signed and issued by the animal and plant quarantine institutions in the port or a quarantine clearance stamp on the cargo list.
3) Medicine: A Qualification Inspection Report issued by the medicine inspection institution in the delivery port.
Sampling Certificate issued by the Food Sanity Supervision Institution in the delivery port or a sampling date on the declaration form.
2. Providing guarantee
For the temporarily imported goods after declaration and approval of customs, the declarer should pay a collateral as tax to the customs or provide a recognized written guarantee for an exemption of import goods certificate or taxation.
3. Examine and release
Temporarily imported goods approved by customs should be open to customs inquiry, and the consignee should be present to move, open and repack the goods when the examination is underway, or the customs could open, examine and sample the goods when it is necessary, according to the 19th clause of the Customs Law.
After declaration, inspection and guarantee, the customs should deliver the temporarily imported goods. But it is only a release not a clearance, thus only a beginning of the customs’ following supervision on the temporarily imported goods. Such supervision will last until the procedures are taken for the goods to be transported abroad.
According to customs regulations in our country, temporarily imported or exported goods approved by the customs should be deliver abroad or home again within 6 month, which can only be extended under special circumstances with the approval of the customs. Such goods can only be used for designated purposes and cannot be opened, taken, deliver, transported, exchanges, modified, mortgaged or used for other purposes without the consent of the customs. The temporarily imported goods will not be supervised anymore by the customs after going through the import formalities, tax payment if they will stay in the country.
4. The list of temporarily imported goods
Temporarily imported goods in our country mainly include those transported in the country for economic, technological, scientific, and cultural cooperation and exchanges by companies, organizations or individuals in foreign countries, Hong Kong, Macau and international organizations, foreign governments. They may include:
1) Filming equipments, films, negatives, tape records, vehicles, costumes and props taken in to make a film, video, pictures and slides by a foreign party or together with domestic corporations.
2) Equipments, props, costumes, vehicles and animals taken in for sports events or artistic performances.
3) Equipments, instruments, tools, teaching apparatus and vehicles taken in for construction, academic and technological exchange and lectures.
